These Terms of Service ("Terms") govern your use of growthkinetics.io (the "Site"), operated by Karvik LLC, a Wyoming limited liability company doing business as GrowthKinetics ("GrowthKinetics", "we", "us", or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our services

GrowthKinetics provides go-to-market systems engineering, outbound, and related consulting services. Any paid engagement is governed by a separate written agreement or proposal between you and GrowthKinetics. If that agreement conflicts with these Terms, the agreement controls.

2. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to, disrupt, or interfere with the Site or its systems.
• Scrape, copy, or republish Site content in bulk without our written permission.

3. Intellectual property

The Site and its content, including text, graphics, logos, guides, templates, and other materials, are owned by GrowthKinetics or its licensors and are protected by intellectual property laws. Free resources we provide are for your personal or internal business use only and may not be resold or redistributed without our written permission.

4. Third-party links and services

The Site links to and uses third-party services, such as Calendly and Tally. We are not responsible for their content, policies, or practices, and your use of them is subject to their own terms.

5. No guarantee of results

Content on the Site, including case studies, results, and examples, is for informational purposes only. Past results do not guarantee future outcomes, and nothing on the Site is legal, financial, or professional advice.

6. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the fullest extent permitted by law, GrowthKinetics will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100).

8. Indemnification

You agree to indemnify and hold harmless GrowthKinetics from any claims, damages, and expenses arising from your misuse of the Site or violation of these Terms.

9. Privacy

Your use of the Site is also governed by our Privacy Policy.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were last changed. Continued use of the Site after changes means you accept the updated Terms.
